The references in these terms and conditions to “we”, “us” or “our” refer to the firm Resume Booth or any associate/subsidiary concern, and “member”, “client”, “you”, “yours” refer to the Client/Candidate/Customer availing the services of Resume Booth and that may be operating the website www.resumebooth.com and its associate sites. Kindly ensure to read the given terms & conditions thoroughly and agree to the same to proceed ahead. Feel free to contact us, in case of confusion/question. The right to change the use policies and terms is solely reserved with Resume Booth. The Members should visit the site periodically to review the Terms and Conditions. For the avoidance of doubt, the Member’s continued use of the Service constitutes an affirmation and acknowledgement of the amended terms and conditions.

2. Links to Resume Booth Websites

All content – textual, still pictures, graphs, voice or video – made available on Resume Booth sites (including content available on our email newsletters and SMS services) (hereinafter referred to as the “content”) belongs to Resume Booth or its partners or licensors. Resume Booth or its partners/licensors own intellectual property rights (including copyright and database rights related to Resume Booth Trademark) in the content. 4. Maintenance of Service

Resume Booth may at any time temporarily deactivate or suspend the Client’s access to www.resumebooth.com and/or the Services (as the case may be) without any prior notice in order to carry out system maintenance, upgrading, testing, repairs and other IT related work. Without prejudice to the other provisions of this Agreement, Resume Booth shall not be liable for any loss and damage, costs and expense that the Client/Member may suffer or incur, and no fees or charges payable by the Client/Member to Resume Booth shall be deducted, refunded or rebated, as a result of such deactivation or suspension.

5. Client’s Obligations

Without prejudice to any other rights or remedies of Resume Booth, Resume Booth may suspend the service agreed or being provided in the event that any dues payable by the Client is not paid completely or is paid partially. Upon suspension, the service shall be deemed to be terminated from the date stipulated by Resume Booth and the Client shall be liable for all charges and fees incurred until that date. Upon subsequent payment by the Client of the requisite payment on demands, Resume Booth may at its sole discretion and subject to such terms as it deems proper, reconnect the Service.

6. Prohibited Use

a) The Client will not allow any person other than the authorized person(s) named in the application/agreement/consent form to use the Service. Resume Booth reserves its right to disclose any information regarding any order only to the person named in the document being processed i.e. to the person to whom the order belongs to.
b) The Client/Member shall use the Service only for the purpose for which it is subscribed.
c) The Client/Member will comply with all applicable laws and shall not contravene any applicable law of India relating to the Services, including any regulation made pursuant thereto.
d) The Client/Member shall not use the Service(s) for any unlawful purpose including without limitation criminal purposes.
e) The Client/Member shall not to use the Service to send or receive any message, which is offensive on moral, religious, racial or political grounds or of an offensive, vulgar, obscene, malicious or menacing nature.
f) The Client/Member is prohibited to introduce post or transmit any information or software, which contains a virus, worm or other harmful component into the Internet or www.resumebooth.com network system.
g) The Client/Member will not breach on any intellectual property rights of any person or retain information in any computer system or otherwise with such intention.

7. Use of Data

The Client/Member hereby agrees and irrevocably authorizes the Company to:

a) Use any data and information supplied by the Client/Member in connection with this Agreement for the Company’s own purpose, to the company supplying such data and information to any other associated companies or selected third parties including search engines.
b) Use any data furnished by the Client/Member in order to float offers or send mails regarding specific services and such mails or messages may not been proclaimed or deemed to be unsolicited communiqué.
c) Allow all data and information supplied by the Client/Member in using the Service to remain at Resume Booth for the use of the Company in accordance with service agreement with the Client/Member, notwithstanding the termination or suspension of the Service to the Client/Member herein.

8. Suspension of Service

Resume Booth reserves the right to block / suspend / hold / de-activate the services of the Client/Member in case, any of the following is found:

b) is offensive to the online community, any such content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
c) involves unsolicited mass mailing or “spamming”, the transmission of “junk mail”, “chain letters”;
d) promotes any information that is misleading, is false or that promotes illegal activities;
e) or where the conduct of the Client is abusive, threatening, obscene, or defamatory towards the firm Resume Booth, and/or towards its employees;
f) promotes unauthorized or an illegal copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices;
g) contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
h) displays pornographic or obscene or sexually explicit material of any kind;
I) provides any kind of instructional information about illegal activities such as violating someone’s privacy, making or buying illegal weapons, or providing or creating computer viruses, or hacking;
j) solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
k) Resume Booth also reserves all rights to suspend or terminate the services if found the services is not being used as per the mentioned instructions or the case may be.

9. Warranties and Limitation of Liability

The content published on Resume Booth website or through its authorised media is for your general information and use and is not intended to address concerns of your particular business or your requirements. Appropriate independent advice should be obtained before making any decisions before getting into arrangement with Resume Booth. Any agreements, transactions or other arrangements made between you and any third party named on (or linked to from) the Resume Booth sites are at your sole risk and responsibility. Resume Booth is not responsible for any use of the content by you outside its scope as stated in these terms and conditions. Resume Booth shall not be liable for any loss or damage of any sort (including loss of time, opportunity, money) arising out of the use and/or non-use, temporary or permanent, of its services. Notwithstanding anything to the contrary contained herein, Resume Booth, liability to you for any cause, whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid only, if any, by you to Resume Booth, for the Service ordered or during the term of your active membership.

10. Our liability exclusion

To the full extent allowed by applicable law, you agree that Resume Booth will not be liable to you for any losses which relate to your business or investment or career choices or which are not a direct consequence of your use of the Resume Booth sites (including lost profits or loss of privacy or loss of or damage to data) or which arise as a result of you using the Resume Booth sites outside the scope of these terms and conditions. In addition to but separate from the above specific exclusion and to the full extent allowed by applicable law, you also agree that Resume Booth will not be liable to you for any other indirect, special, consequential incidental, punitive or exemplary damages whatsoever that arise out of or are related to your use of the Resume Booth sites.

11. Your remedies

Resume Booth shall use reasonable endeavours to promptly remedy any faults in the Resume Booth sites of which it is aware. You agree that your only other remedy (including for negligence) for any damages that you incur arising out of your use of the Resume Booth sites to the extent that Resume Booth liability is not excluded is as follows: if you have subscribed to receive any paid services, your remedy is limited to the direct damages you actually incur arising out of your use of the Resume Booth sites. This is subject to a limit equal to the amount paid by you to Resume Booth pursuant to these terms and conditions during the financial year in which the damage is incurred. You may at your option receive paid services to the equivalent value of this limit in place of monetary damages.

12. Indemnity

Without limiting the above, Resume Booth is not liable for matters beyond its reasonable control. Resume Booth does not control telephones, third party communications networks (including your Internet Service Provider) or the Internet or the acts of third parties. You agree to indemnify and hold Resume Booth, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above.

13. Third Party Sites and Services

The Resume Booth sites may contain links to other Internet websites or online and mobile services provided by independent third parties (“Third party sites”), either directly or through frames. Third party sites may be co-branded with Resume Booth and so include Resume Booth trade mark. Resume Booth is not responsible for the availability or content of Third party sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third party sites. If you purchase products or services from a Third party site your contract for such products or services will be with the third party and not with Resume Booth. Our privacy policy does not apply to Third party sites. The Resume Booth sites may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Resume Booth sites comply with international and national law. Resume Booth will not be responsible for any error or inaccuracy in advertising or sponsorship material.

14. General

From time to time Resume Booth or www.resumebooth.com may run competitions, prize schemes, promotions, offers and surveys on all its websites. These may be subject to additional terms and conditions that will be specified at the time they are run. You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions. If any provision of these terms and conditions is found to be invalid by any Indian court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect. Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect. We have not authorized any individual or organization to collect payments in any other name (i.e. any other individual or organization name) for any services rendered by Resume Booth. You are informed that under no circumstances will Resume Booth be liable for any damage caused of whatever nature because of such fraudulent individuals or organizations. If you come across or is aware of any such activity, kindly immediately report is to legal@resumebooth.com.

15. Technical Requirements and Site Security

Resume Booth and its associated sites are best viewed using the Internet browser IE 5.5 or higher versions. Any older browser versions may work but users could have a limited browsing experience. The Resume Booth site may not work well with Netscape versions. Payments to Resume Booth are facilitated through Razor pay payment gateway PayPal and a few more. Any member who make payment through ww.resumebooth.com by default agree to the terms and conditions indicated by the respective payment gateway.

16. Disclaimer

Resume Booth shall not be liable for any loss of information howsoever caused whether as a result of any interruption, suspension, or termination of the Service or otherwise, or for the contents, accuracy or quality of information available, received or transmitted through the Service. The Client/Member shall be solely responsible, and Resume Booth shall not be liable in any manner whatsoever, for ensuring that in using the Service, all applicable laws, rules and regulations for the use of systems, service or equipment shall be at all times complied with. Resume Booth makes no representations and warranties of any kind, whether expressed or implied, for the Services and in relation to the accuracy or quality of any information transmitted or obtained through the Services of www.resumebooth.com. Resume Booth shall not be liable for any loss or damages sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the Client’s/Member’s account and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed. The Client/Member acknowledges that it is not the organisation’s policy to exercise editorial control over and to edit or amend any data or contents of any emails or posting or any information that may be inserted or made available or transmitted to a third party in or through resumebooth.com. Resume Booth may refuse, suspend, terminate, delete or amend any artwork, materials, information or content of any data or information or posting so as, in the sole opinion of Resume Booth, to comply with the legal or moral obligations and to avoid infringing a third party’s rights or any other rules, standards or codes of practices that may be applicable to the posting or www.resumebooth.com or the internet.

17. Privacy Policy and Registration

All information(s) received from you for your use of the Resume Booth sites will be used by Resume Booth in accordance with our Privacy Policy. On registration, you must provide Resume Booth with accurate, complete registration information and it is your responsibility to update and maintain changes to that information on the applicable Resume Booth site registration pages. This is particularly important if you subscribe to any paid services or info-mails or newsletters of Resume Booth. On registration, you will be either given an Order ID generated online or a User Name and Password. Resume Booth does not permit any other person sharing his User Name and Password or Access to multiple users. Resume Booth may cancel or suspend access to the Resume Booth sites if you do this without prior written consent. Each registered Client/Member is individually responsible for usage of any type of Resume Booth information or anyone else using your ID and for preventing unauthorised use of your ID or registration info. If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID or any payment information, you must notify Resume Booth immediately by e-mailing contact@resumebooth.com. We recommend you to change password of your User Name on regular basis to avoid any misuse. If you provide Resume Booth with an email address or phone number that results in any emails or SMS messages from Resume Booth being sent to you via a computer network or telephone operated or owned by a third party (e.g. your employer or your institution) then you warrant that you are entitled to receive those messages. You also agree that Resume Booth may refrain from sending messages to you without notifying you, even if you have subscribed to receive them, if we receive a request from a third party to stop sending emails or SMS messages to you.

18. Confidentiality

Resume Booth maintains a policy of strict confidentiality of all data and information submitted by the Member. Members need to be aware that when they voluntarily reveal identification oriented information (name, e-mail address) in chat and bulletin board areas, such information may be collected by a third party resulting in unsolicited messages from third parties. Such interaction is beyond the control and liability of Resume Booth. The copyright, know how or any other related intellectual property to the Service or Resume Booth shall be the sole and exclusive property of Resume Booth. In the event the Client/Member has contributed any content to Resume Booth in any manner whatsoever, the intellectual property of the same shall stand automatically assigned to Resume Booth and the Client/Member shall have no right or claim over the same. In the event the Client/Member during the term of his agreement or any time thereafter, uses such intellectual property in any other website or related activity, the same can be construed to be an infringement of the intellectual property belonging to Resume Booth and Resume Booth shall have the right to legal recourse in this regard.

19. Paid Services

(a) Resume Development Service: Resume Booth operates several paid services (See “Register/Registration” section). By subscribing to receive any of these services, as well as the above terms and conditions, you are also agreeing to the following terms:
a) The Client/Member will comply with all notices or instructions given by Resume Booth from time to time in respect of the use of the Service.
b) Certain areas of services of Resume Booth sites are only accessible to users who pay to subscribe.
c) You agree to pay any subscription fees at the rates in effect when the charges are incurred.
d) Resume Booth will start its paid services only upon realisation of the complete amount/fee/charges upfront, full in advance. Resume Booth reserves its right to hold/suspend any order if full payment is not received or partial payment is made.
e) If we do not receive payment authorisation or any authorisation is subsequently cancelled, (either by the bank or payment gateway or banking partner or the Client) we may immediately terminate or suspend your access to any paid-for services.
f) You must provide us with complete and accurate payment information.
g) In the case of unauthorised payments Resume Booth reserves the right to suspend or terminate your access to the online services.
h) You can pay by either credit or debit card through your bank’s internet payment gateway. By submitting credit or debit card payment details to Resume Booth you warrant that you are entitled to purchase the subscription services using those payment details.
i) Resume Booth will charge you in Indian rupees (INR), and any payment in other any other currency will be calculated at the relevant rates of exchange. You may also have to pay any applicable local taxes. Resume Booth will not entertain any dispute about the rate at which your currency is converted into Indian Rupees since these transactions are determined as per the agreement of Resume Booth with Razor Pay/PayPal or any banking partner or our payment gateway partners, and their agreement with banks and credit card companies.
j) The service would entail you to receive a soft copy of resume from Resume Booth. Not more than one resume (or as per order placed) is provided per service request and this does not compulsorily include a covering letter.
k) Resume Booth will try to process your order/subscription promptly but does not guarantee that the paid services will be available to you within your specified time. We work according to our organisation timelines. Whenever any change / modification is requested in the resume after the delivery of first version/draft, it takes approximately 3-7 working days to revert back with the modified resume whenever requested for. Also as it is practically not possible to keep making changes on every single request, hence, it is recommended to our Clients that they provide us all the desired modifications in one single mail, to complete them at the earliest.
l) Our delivery period starts from the same time of next working day, after the date on which payment hits the account of Resume Booth.
m) Resume Booth reserves the rights to reject working on any resume at any stage of the process, if it is noticed that the terms and conditions have not been complied with.
n) Resume Booth would provide the subscribed services only within the time period mentioned in our email communications to you or as mentioned on our website for said service and provided that all required information’s are received on time and are complete as per expectations of Resume Booth.
o) Please note that as a process we cannot keep our old orders in ‘open’ status for longer duration especially in cases where the Client(s) do not respond back or provide any communication for 30 days (non-communication period). Hence in such conditions where there is no communication received from the Client on his/her order for 30 days from the date of last communication / date of last delivery made to the client, the order will be automatically marked as Closed and no further support will be provided on this Order after that.
p) To re-activate closed order again for any modifications/changes/re-print/re-delivery or for any other purposes i.e. after 30 days of the non-communication period mentioned in above clause, the client will have to make the payment of not less than 50% of the original order amount again.
q) There will be separate charges for re-writing the resume again, if required to suit a different job profile other than the one availed for and once the non-communication period of 30 days is expired.
r) Resume Booth offers no job guarantee or assurance for the resume developed. The service would only help you get your resume crafted in a powerful way and as per the market trends.
s) The liability, if any, of Resume Booth is limited to the extent of the amount paid by the Client/Member.
t) All outstanding balances must be cleared and must be paid in full in order to avail the complete services of the services subscribed/registered for.
(b) Placement Consultancy Service: Resume Booth operates several paid services (See “Register/Registration” section). By subscribing to receive any of these services, the Candidates/Member/Job-Seeker agrees to the following terms and conditions as well as the other applicable terms and conditions mentioned on our website www.resumebooth.com:
a) Resume Booth Placement Consultancy Service is a facility provided to assist job-seekers to find a suitable job in Corporate/Private/Industrial sector.
b) Resume Booth Placement Consultancy Service does not guarantee or provide assurance of any job from the services being offered.
c) These are process based initiatives which helps candidates find suitable job opportunities. Final selection in a job depends upon many aspects like performance during interview, academic & practical knowledge, agreeing to compensation package, location of job, positive verification of credentials etc.
d) The registration for Placement Consultancy Service does not assure or guarantee job to all registered members.
e) The registration shall be for a specified period as per the policies.
f) All outstanding balances must be cleared and must be paid in full in order to avail the complete services of the services subscribes/registered for.
g) Resume Booth reserves its right to reject / modify any insertion or information/data provided by the user without assigning any reason.
h) Resume Booth would not be held liable for any loss of data technical or otherwise, information, particulars supplied by the individual due to the reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond reasonable control including but not limited to strike, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities.
i) Resume Booth Placement Consultancy Service facilitates the posting of vacancies on Resume Booth & other job portals and websites, and thereafter Resume Booth sponsors the candidates to employer. Selection & rejection of candidate is totally at the discretion of employers and Resume Booth has no role in selection of candidate. The employers contact the candidates directly or through Resume Booth, if shortlisted.
j) Getting a job does not guarantee your immediate discharge from current services, if any and Resume Booth would have no role in processing of your relieving from your current employer. You are advised to adhere to your current organisations HR Policies.
k) Before applying for job individual should have all the necessary permissions from its current employer of obtaining NOC/Releasing/Discharge order etc.

m) The vacancies displayed on the site is at the sole discretion of Resume Booth and Resume Booth will not be responsible for any change thereafter with respect to salary, location or other details published.
n) The candidate should satisfy themselves with the terms and conditions of the job during interview.
o) Complaints of any sort against the employer will not be entertained by Resume Booth. Any grievances in this regards may be taken up directly with employer.
p) The Member / Job-seeker is solely responsible for the accuracy of the Registration Data given to Resume Booth in the application for membership in order to use the Service.
q) The Member is responsible for the set-up or configuration of all the necessary equipment required to access the Service.
r) The Member will comply with all notices or instructions given by Resume Booth from time to time in respect of the use of the Service.
s) The Member shall be solely responsible for all information retrieved, stored and transmitted through the Service by him.
t) The Member is solely responsible for the maintenance of confidentiality of the login information. This would include the Member’s password and Member Username and all activities and transmission performed by the Member at www.resumebooth.com.
u) The Member will immediately notify the Company of any unauthorized use of the Member’s account or any other breach of security known to the Member.
v) The Member will take all such measures as may be necessary (including without limitation changing his password from time to time) to protect the secrecy. Resume Booth shall not be held responsible for any loss of information/data due to mishandling/mismanagement of User Account. w) The Member agrees to pay promptly the Service Charges / Fees against the services requested from Resume Booth from time to time.
(c) Recruitment Consultancy Service: In order to use the services provided by Resume Booth, Employers/Consultants/Corporates/Companies must sign an agreement or register as a member of www.resumebooth.com and agree to be bound by these Terms of Use. This Agreement (Terms of Use) sets out the legally binding terms for your membership. This Agreement is subject to modifications without any prior notice. These Terms are in addition to the agreement signed or offered agreed between us. The Member will comply with all notices or instructions given by Resume Booth from time to time in respect of the use of the Service. Recruitment Consultancy Service is defined as the services to be provided to the Employer(s)/Consultant(s)/Corporate(s)/Company(s) by Resume Booth including the provision of facilities for the following:
a) A Member who wishes to reach a job seeker.
b) A Member who wishes to hire a job seeker through Resume Booth.
c) A Member who wishes to advertise at www.resumebooth.com.
d) Member who wishes to receive advertisements, newsletters and promotional messages on www.resumebooth.com and through its emails.

20. Refund Policy

a) If you are, for any reason, not happy with your purchase, we will cheerfully raise your refund request received within 24 hours of your purchase, if any. This condition excludes the Orders placed under Express Delivery where the First Draft of Resume / Service is delivered within 24 hours. There is Zero Refund policy for Express Delivery Orders.
b) We develop and cater our services every day to lots of satisfied customers, and our support is second to none. To request a refund, simply mail us your request on contact@resumebooth.com with your order details within Twenty Four Hours (24 Hrs) of your purchase. Please include your Order Number (informed to you while placing order) and optionally tell us the reason why you’re requesting a refund – we take customer feedback very seriously and use it to constantly improve our products and quality of service.
c) No requests for refunds will be entertained made after 24 hours of your purchase.
d) Taxes deducted once will not be refunded back in any case.
e) Refund requests will be processed and managed on case to case basis and the decision to refund will be made in the absolute discretion of Resume Booth.
f) If agreed by Resume Booth, refund will be processed and will be credited back to the original credit/debit card or bank account as per the timeframe of respective Bank which is usually between 75 days (for VISA/MASTER) and 120 days (for AMEX) as per their rules. Resume Booth does not have any control on the processing or timelines prescribed by the bank and is not responsible for any such issues.
g) Resume Booth will not refund the payment/charges for Resume Development Service once the payment has been made to Resume Booth and the process has been initiated which includes the first level discussion with the assigned Resume Writer. Refunds are not being provided for any service which is delivered in partial or full, such as after delivery of first draft, or after having carried any modifications/iterations/rectifications as per client feedback.
h) In the case of unauthorised payments / payment rejected / transaction marked as high-risk / stolen or fraud cards / chargeback or refund, either written or verbal to the bank / credit card company / payment gateway, Resume Booth reserves the right to suspend or terminate your services with immediate effect, either temporarily or permanently, partial or completely and no further services or support or responses will be provided to the client until the disputed subject matter is resolved.
i) In case any member defames Resume Booth on public forum / blogs / public domains & websites / Social Media sites, same will be considered as acting against Resume Booth and hence the member / client order ID will be blocked in the system with immediate effect and no further request of any sort/value will further ever be entertained by Resume Booth till he / she removes the post. Resume Booth will also have the right to take a legal action / file a case against such people / clients participating in such activities.

21. Governing Law and Jurisdiction

This Agreement, accepted upon use of the Site and further affirmed by becoming a Client/Member of the Resume Booth service, contains the entire agreement between you/member and Resume Booth regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. These terms and conditions shall be governed by, and construed in accordance with laws of the Government of India. Users of Resume Booth websites also explicitly agree that only courts in India shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions, and for those purposes irrevocably submit all disputes to the jurisdiction of Indian courts. You are solely responsible for your interactions with Resume Booth and Resume Booth reserves the right, but has no obligation, to monitor disputes between you and other Members or any third-party. Any dispute arising out of this agreement will be subject to the jurisdiction of Noida and no courts other than courts of Noida shall have jurisdiction to try the same. Any dispute between the parties shall be referred to a named arbitrator appointed by Resume Booth under the Arbitration and Conciliation Act of 1996. The decision of the Arbitrator shall be final and binding on both the parties. The Arbitration proceeding will be conducted at Noida in English language only.

All communication, including notices and legal communications, should be addressed to The Founder, Resume Booth, at the mentioned address.

23. Changes to Terms and Conditions

These terms and conditions are effective from Dec 21, 2020.
